Terms & Conditions

These Terms and Conditions set out the terms that apply when you use the TWOPAGES website or purchase products from us online. Please read them carefully before placing an order.

General Terms

Throughout these Terms and Conditions (“Terms”), “TWOPAGES”, “we”, “us” and “our” refer to the TWOPAGES team. “You” and “your” refer to the person using our website or purchasing products from us.
By accessing or using our website, creating an account or placing an order, you agree to these Terms together with any other policies or terms that apply to your use of our website or purchase.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL), or any other rights that cannot lawfully be excluded.

Using Our Website

TWOPAGES grants you a limited, non-exclusive, non-transferable and revocable right to access and use our website for personal and lawful purposes in accordance with these Terms.
You must not use our website:
  • in breach of any applicable law or regulation;
  • for fraudulent, misleading or unlawful purposes;
  • to interfere with the security or operation of the website;
  • to gain unauthorised access to our systems or another person's account;
  • to introduce viruses, malware or other harmful code; or
  • to commercially exploit the website or its content without our permission.
You are responsible for ensuring that your use of our website complies with applicable laws.

Your Account

You may be able to create an account to access certain features of our website.
You are responsible for:
  • providing accurate and current account information;
  • keeping your login details secure; and
  • taking reasonable steps to prevent unauthorised access to your account.
If you believe your account has been accessed without your permission, please contact us promptly.
We may suspend or restrict access to an account where we reasonably believe this is necessary to protect our customers, our website or our business, or where the account has been used in breach of these Terms.

Orders

When you place an order, you are making an offer to purchase the products in your order at the price displayed at checkout, subject to these Terms.
After you place an order, we may send you an order acknowledgement or confirmation.
Your order is subject to acceptance by TWOPAGES. We may contact you if additional information is required before we can process or fulfil your order.
We may refuse or cancel an order where reasonably necessary, including where:
  • a product is unavailable;
  • we are unable to process or verify payment;
  • information provided with the order is incomplete or incorrect;
  • we reasonably suspect fraud or unauthorised activity;
  • there is an obvious pricing, product information or technical error; or
  • we are unable to fulfil the order for another legitimate reason.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order using the original payment method where reasonably practicable.
Nothing in this section affects any rights you may have under the Australian Consumer Law.

Product Information

We aim to provide accurate information about our products, including descriptions, specifications, measurements, colours, materials and images.
However, colours and other visual details may appear differently depending on your screen, device, display settings and lighting conditions.
For products made or supplied according to measurements or specifications selected or provided by you, you are responsible for checking the information you submit before placing your order.
Please review your product selections, measurements and other order details carefully before completing your purchase.
Nothing in this section limits any consumer guarantee or other right you may have under the Australian Consumer Law.

Prices and Payment

Prices and charges applicable to your order will be shown during the ordering process.
You are responsible for checking the total amount displayed before placing your order.
We accept the payment methods made available at checkout. Payments may be processed by third-party payment providers and may also be subject to the relevant provider's terms and conditions.
You must provide accurate and authorised payment information.
We may verify payment information or request additional information where reasonably necessary to process your order or prevent fraud.
If payment cannot be successfully processed, we may be unable to accept or fulfil the relevant order.

Pricing and Website Errors

We take reasonable care to ensure that product descriptions, prices and other information displayed on our website are accurate.
However, genuine typographical, technical or other errors may occasionally occur.
If a product is displayed with an obviously incorrect price or information due to a genuine error, we may contact you to explain the issue and, where appropriate, give you the option to proceed with the corrected information.
Where we are unable to fulfil an order because of a genuine pricing or technical error, we may cancel the affected order and refund any amount already paid for that order.
If incomplete or incorrect pricing appears because information has not loaded correctly during product customisation or checkout, please check that all selections and the final amount are displayed correctly before placing your order.
Nothing in this section limits your rights under the Australian Consumer Law.

Consumer Guarantees, Returns and Refunds

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Our Returns & Refunds Policy, Warranty Policy and any other voluntary policy or warranty we provide operate in addition to, and do not replace or limit, your rights under the Australian Consumer Law.
Where you request a return, refund, repair, replacement or other remedy, we may ask you to provide reasonable proof of purchase and information that allows us to assess the issue.
Change-of-mind returns, cancellations and exchanges are subject to the conditions set out in our applicable Returns & Refunds Policy and Cancellation Policy.
If you have an issue with a product or order, please contact us at support@twopagescurtains.au.

Delivery

Delivery information, charges and available options will be provided during the ordering process or in our Shipping Policy.
Estimated dispatch and delivery timeframes are estimates unless we expressly agree otherwise.
Delivery may be affected by circumstances outside our reasonable control, including carrier delays, severe weather, customs processing and other disruptions.
If there is a significant issue with the delivery of your order, please contact us so that we can investigate and assist.
Nothing in this section limits any rights or remedies available to you under applicable Australian law.

Intellectual Property

Unless otherwise stated, our website and its content, features and functionality, including text, graphics, images, photographs, videos, logos, designs and software, are owned by or licensed to TWOPAGES and are protected by applicable intellectual property laws.
You may access and use website content for your own personal, non-commercial use.
Unless permitted by law or expressly authorised by us, you must not:
  • copy or reproduce our website content;
  • modify or create derivative works from it;
  • sell, license or commercially exploit it;
  • remove or alter copyright, trade mark or other proprietary notices; or
  • reverse engineer, decompile or disassemble website software.
Nothing in these Terms transfers ownership of TWOPAGES intellectual property to you.

Copyright Concerns

If you believe that material appearing on our website infringes copyright or other intellectual property rights, please contact us and provide enough information for us to understand and assess your concern.
This may include:
  • identification of the protected work;
  • identification of the material you believe is infringing;
  • your contact details;
  • an explanation of the basis for your claim; and
  • confirmation that you are the rights holder or are authorised to act on behalf of the rights holder.
We may request additional information where reasonably necessary to review the matter.

Feedback and Submissions

If you voluntarily provide feedback, comments, suggestions or ideas about our website, products or services, you give us permission to use that feedback for legitimate business purposes, including improving our products and services.
Nothing in this section transfers ownership of your material to TWOPAGES where doing so would be unlawful or where separate terms apply.
If separate terms apply to a promotion, design submission, competition or other activity, those terms will apply to submissions made as part of that activity.

Promotions

From time to time, TWOPAGES may offer promotions, competitions or other promotional activities.
Additional terms, eligibility requirements or conditions may apply to a particular promotion.
If you choose to participate, please review the terms applicable to that promotion before entering.
Where there is an inconsistency between these Terms and the specific terms of a promotion, the specific promotion terms will apply to that promotion to the extent of the inconsistency.

Third-Party Websites and Services

Our website may contain links to or integrate with websites, platforms, applications, payment services or other services operated by third parties.
Third-party services are independently operated and may be subject to their own terms, privacy policies and other conditions.
TWOPAGES is not responsible for the operation or content of independent third-party websites or services, except to the extent that responsibility cannot lawfully be excluded.
We encourage you to review the relevant third-party terms and policies before using their services.

Cookies

We use cookies and similar technologies to support website functionality, remember preferences, understand how our website is used and support other website features.
You may be able to manage cookies through our cookie settings and your browser controls.
Disabling certain cookies may affect the operation or functionality of parts of our website.
For more information about our use of cookies and similar technologies, please refer to our Cookie Policy.

Website Availability and Updates

We may update, modify or improve our website and its features from time to time.
We may also temporarily suspend access to all or part of the website where reasonably necessary for:
  • maintenance;
  • security;
  • technical changes;
  • system updates; or
  • events outside our reasonable control.
We do not guarantee that the website will always be available without interruption or that every feature will remain available indefinitely.
Nothing in this section limits any rights you may have under applicable law.

Website Information and Disclaimers

We take reasonable care in providing information through our website.
However, website information may occasionally contain errors or become outdated.
To the extent permitted by law, we do not guarantee that:
  • the website will always be available or uninterrupted;
  • the website will always be free from errors;
  • every feature will operate on every device or browser; or
  • third-party content or services will always be available or accurate.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, warranty, condition, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

Limitation of Liability

To the maximum extent permitted by law, TWOPAGES will not be liable for loss or damage to the extent that it was caused by circumstances outside our reasonable control or by your own acts or omissions.
Nothing in these Terms excludes, restricts or modifies any liability, consumer guarantee, right or remedy where doing so would be unlawful.
In particular, nothing in these Terms is intended to exclude or restrict any right to a repair, replacement, refund, compensation or other remedy available under the Australian Consumer Law.

Your Responsibility for Using the Website

You are responsible for using our website lawfully and in accordance with these Terms.
To the extent permitted by law, you are responsible for loss or damage suffered by TWOPAGES as a direct result of your unlawful use of our website or your material breach of these Terms.
Nothing in this section requires you to compensate TWOPAGES for loss caused by TWOPAGES or for any liability that cannot lawfully be transferred to you.

Suspension or Termination of Website Access

You may stop using our website at any time.
We may suspend, restrict or terminate your access to our website or account where reasonably necessary, including where:
  • you materially breach these Terms;
  • we reasonably suspect fraudulent or unlawful activity;
  • your use creates a security risk;
  • we are required to do so by law; or
  • the relevant website feature or service is discontinued.
Where appropriate and reasonably practicable, we may provide notice before taking such action.
Suspension or termination does not affect rights or obligations that arose before the suspension or termination.

Resolving Disputes

If you have a concern about an order, product, service or these Terms, please contact us first so that we have an opportunity to understand and address the issue.
You can contact us at support@twopagescurtains.au.
Nothing in these Terms prevents you from exercising any rights or using any dispute resolution options available to you under Australian law, including contacting an applicable state or territory consumer protection agency or pursuing a matter through a court or tribunal where available.

Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where possible.
If that is not possible, the affected provision may be severed without affecting the remaining provisions of these Terms.

Waiver

If either party does not immediately exercise a right under these Terms, this does not mean that the right has been waived.
A waiver of one breach does not automatically constitute a waiver of any later breach.

Entire Agreement

These Terms, together with our applicable policies and any additional terms presented to you in connection with a particular product, service or promotion, form the agreement between you and TWOPAGES relating to your use of our website and relevant online purchases.
Additional terms may apply to particular products, services or promotions. Where applicable, those terms will be made available as part of the relevant offer or purchase process.
Nothing in this section excludes or limits any rights that cannot lawfully be excluded.

Changes to These Terms

We may update these Terms from time to time to reflect changes to:
  • our website or services;
  • our products and business operations;
  • applicable laws or regulatory requirements; or
  • security or technical requirements.
Any revised Terms will be published on our website.
Changes to these Terms will not retrospectively remove or reduce rights you have in relation to purchases already made where doing so would be prohibited by law.
